Synopsis
Water is a renewable but limited resource, and rivers and lakes do not stop at borders. This book examines how the law responds to their pollution on three levels that shape one another: Romanian legislation, European Union rules and the international law of watercourses.
The author follows the development of the Romanian Water Law and its permit regime, the forms of liability (environmental, administrative, criminal and civil), the Water Framework Directive and its application in the Netherlands, France and Germany, the Helsinki (1992) and New York (1997) Conventions, and the legal regimes of the Danube, Tisza and Rhine basins. A large part is devoted to international, European and Romanian case law, from the Gabcikovo-Nagymaros case to the Sandoz and Baia Mare accidents.
The book closes with proposals de lege ferenda, including the consolidation of Romanian water legislation into a single Water Code. It is based on the author's doctoral thesis at the Faculty of Law of the University of Bucharest, and the law is stated as of 11 August 2021.
